A change to United States Immigration and Customs Enforcement reporting rules is receiving renewed attention after the death of José Chajon Raxón, a Guatemalan man who had a seizure after entering Delaney Hall in Newark, New Jersey. Associated Press reported that DHS said he was transferred to hospital and released from ICE custody on 22 July. He later died.
In June, ICE rescinded a Biden era policy that required reporting and investigation of certain deaths occurring within 30 days after a person left custody. Under the current policy, ICE says it is no longer responsible for monitoring or reviewing deaths after custody has ended.
What is confirmed and what is not
The policy change is confirmed, as is the reported sequence of hospital transfer and release in this case. Members of Congress and advocates have argued that the change can reduce independent scrutiny of serious medical cases. DHS has said ICE remains committed to transparency.
